Dear visitors, please read these Terms and Conditions carefully before using this website and before completing an order. By using this website, you are deemed to have accepted and agreed to the published Terms and Conditions.

Art. 1 (1) These General Terms and Conditions govern the relationship between users of the websites and services located at the domain www.travelbooks.bg, its subdomains, and our Facebook page (hereinafter referred to for brevity as the “Site,” “Website,” “Webpage, ” “Online Store,” “Merchant,” “Seller,” “TRAVEL BOOKS, “Store,” “We”) and apply to our relationships with individual customers (hereinafter referred to as “You,” “Buyer,” “Customer,” “User”) who access the website or our social media page administered by us.

(2) For corporate customers (hereinafter referred to as “Merchant Customer,” “You,” “Buyer,” or “Customer”) using the services and products offered on the Website, the General Terms and Conditions apply to a limited extent. The rules regarding returns and exchanges set forth in Section IX, as well as the rules regarding warranties and complaints set forth in Section X, do not apply to merchant customers. If you are a legal entity and place an order on our website, you may contact us to negotiate these terms on an individual basis.

(3) In cases where a consumer or business customer has placed an order through the website, it is deemed that a distance sales contract has been concluded with the online store, to which these General Terms and Conditions apply.

(4) These General Terms and Conditions apply to orders placed on the Website, as well as to requests for goods or services made by a consumer to the merchant via telephone, email, or social media.

Article 2 You agree to comply with all provisions of these Terms and Conditions when using the Site.

Throughout these General Terms and Conditions , the terms “Site,” “Website,” “Internet Page,” “Online Store,” “Merchant,” “Seller,” “TRAVEL BOOKS,” and “We” shall be understood to mean the online store www.travelbooks.bg, operated and administered by “Travel Books” Ltd.

III. DEFINITIONS

Article 5 (1) “User” means any adult individual who uses the Site in any manner, including by browsing it, registering on it, and/or purchasing a product or service by placing an order on the Site.

(2) “Merchant Customer” means any legal entity or other legal formation that uses the Site in any manner, including by browsing it, registering on it, and/or purchasing a product or service by placing an order on the Site.

(3) “Customer” means any natural or legal person who has placed an order for goods or services on the Website.

(3) “Merchant” and “Seller” refer to “Travel Books” Ltd.

(4) “Account” and “Profile” refer to a section of the Site consisting of an email address, a password, and the personal data of a user or merchant client, which allows them to use the Site’s services in cases where an account is required for such use and/or to view their orders.

(5) “Manufacturer” means a natural or legal person who, as a business, manufactures the goods offered in the online store and/or whose name, business name, manufacturing mark, or other distinctive mark is indicated on the goods, their packaging, or the commercial documentation.

(6) “Site,” “Online Store,” “Merchant,” “Seller,” “TRAVEL BOOKS,” “Store,” “Website” means the website located at the following web address: www.travelbooks.bg, as well as any page on social media or the Internet that is in any way connected to www.travelbooks.bg.

(7) “Goods” and “Products” refer to all items in the store that are movable property, identified by a detailed description and/or color image, and for which a price and/or manufacturer is specified.

(8) “Services” means all services provided in the store that are not goods, are customized, and have a price.

(9) “Contract,” “Distance Contract,” “Order,” “Order”covers all cases in which a contract is concluded between TRAVEL BOOKS and a customer through one or more of the following methods: i) an order by mail; ii) an order via the Internet (website, email, social media, platform); iii) an order by phone or fax.

(10) “Distance Contract Subject to a Condition Precedent” means a distance contract concluded between a Customer and TRAVEL BOOKS, provided that it is to be performed under the agreed terms only if the seller is able to do so. The seller is deemed to be able to perform the contract if all of the following conditions are met: i) the seller has the goods in stock (in the case of an order for goods); ii) the seller can perform the contract within the agreed timeframe and under the agreed terms. The condition precedent is deemed to have been fulfilled, and the contract becomes binding on the parties from the moment the seller, either personally or through a third party, has confirmed to the buyer the ability to deliver the goods or service under the agreed terms. The condition precedent is deemed not to have been fulfilled, and the contract is not binding on the parties, if the seller notifies the buyer of the inability to perform, as well as in the absence of notification within 7 business days of the order that the seller is able to perform the contract.

IV. GENERAL PROVISIONS

Art. 6 (1) Access to the Site for the purpose of placing an order or creating an account is permitted to any person. Registration as a user on the Site is at the visitor’s discretion.

(2) TRAVEL BOOKS’ Terms and Conditions are binding on all users and customers of the Site. Any use of the Site implies that you have carefully reviewed the Terms and Conditions and have agreed to comply with them unconditionally.

(3) If any provision of these General Terms and Conditions for Use of the Site is found to be invalid or unenforceable, for any reason whatsoever, this shall not render the remaining provisions invalid or unenforceable.

(4) The website reserves the right, at its sole discretion, to restrict any customer’s access to placing an order and/or to any of the available payment methods, if it deems that this would be detrimental to the seller in any way. In such a case, the customer has the right to contact the “Customer Relations” department of the Website via the contact form or the contact information provided in Section II of these General Terms and Conditions, in order to be informed of the reasons that led to the application of the aforementioned measures. The Site shall not be liable for any damages that the customer has suffered or may suffer as a result of this decision, provided that it is justified and well-founded.

(5) In certain cases, the customer has the right to post reviews regarding goods and/or services, as well as to contact the Site at the addresses listed in the “Contact Us” section. Opinions or messages containing profanity or inappropriate language will be removed from the Site or ignored.

(6) The Site may publish advertising or promotional information about the goods and/or services and/or the promotions it offers on the Site for a specified period of time.

(7) The specifications or prices of the products and services described on the Site are subject to change at any time. For technical reasons, these may contain errors, for which TRAVEL BOOKS apologizes in advance to its users and customers and hereby notifies them that it bears no responsibility for any errors that may occur.

Art. 7 (1) These General Terms and Conditions may be amended unilaterally by TRAVEL BOOKS at any time by updating them on the website, subject to the provisions of the Consumer Protection Act (CPA).

(2) The updated General Terms and Conditions take effect immediately upon their publication on the Website for all future customers and users, as well as for contracts with corporate customers entered into prior to the amendment.

(3) Amendments to the General Terms and Conditions do not affect distance contracts concluded prior to the update, unless TRAVEL BOOKS has provided otherwise in accordance with applicable law and Article 8 of these General Terms and Conditions.

Art. 8 (1) If TRAVEL BOOKS wishes to apply the amended General Terms and Conditions to consumers with contracts (orders) that are in effect and have not been terminated as of the date the terms are updated, the merchant shall notify the consumers by email within 7 days of the amendment.

(2) If the consumer does not agree with the amendments to the general terms and conditions, the consumer may , within one month of receiving the notification, withdraw from the contract by sending a written notice to TRAVEL BOOKS , without giving a reason and without owing any compensation or penalty, or continue to perform the contract under the General Terms and Conditions in effect prior to the amendment.

(3) If the user fails to do so within the specified time limit, the updated General Terms and Conditions shall take effect with respect to the user one month after the notification.

(4) The General Terms and Conditions shall take effect immediately for all customers, without the need for notice, if the changes made to the terms and conditions are required by a regulatory act that has entered into force.

(5) The updated General Terms and Conditions are binding on merchant customers as of the date of their update or as of the date specified in the notice of amendment.

Article 9 TRAVEL BOOKS makes every effort to ensure the accuracy of the information presented on the Site. However, given the possibility of technical errors or omissions in this information, TRAVEL BOOKS notes that product images are for illustrative and guidance purposes only; therefore, the products delivered may differ from the images.

Art. 10 (1) All goods, including those on sale or at a discount, are sold and delivered while supplies last, even if this is not expressly stated on the Website.

(2) Some advertisements and offers are subject to a minimum or maximum quantity that may be purchased by a single customer. If applicable, this is described in detail in the individual offer.

Art. 11 The website may contain links to other websites. TRAVEL BOOKS is not responsible for the privacy policies and terms of use of websites it does not administer, nor for any other information contained therein.

Art. 12 All images posted on the Site are intended solely to provide a general idea of the type of goods or services offered, and not to represent them accurately. Accordingly, it is possible that some of the images of the goods or services on the platform (static/dynamic images, multimedia presentations, etc.) may not correspond to the actual appearance of the relevant goods or may create a misleading impression of the service offered. The seller shall not be liable for such discrepancies, unless they are material.

  1. ENTERING INTO A CONTRACT

Placing an Order Through the Website

Art. 13 (1) The customer expresses their desire to order/purchase goods/services through the Website by placing an order electronically; this can be done with or without a registered account on the Website. You may also place an order by phone or email; in this case, you will receive an email at the address you provide. Once you have accepted the General Terms and Conditions, your order will be considered placed.

(2) The consumer, provided he or she is at least 18 years of age, has the right to order all goods and services listed on the Website, unless they are out of stock, and only if the consumer is legally capable of entering into binding contracts.

(3) When placing an order through the Site, the User has the right to select the type of goods or services, as well as their quantity, based on the options offered on the Site. The system may also prompt you to select other characteristics (such as color) if the selected products or services are available in different variations.

(4) Once you have selected the products/services you want from the website, as well as their quantities, you should proceed with the ordering process, where you have the option to proceed directly to checkout or continue shopping on the Site.

(5) Before completing your order, you will have the opportunity to select your payment method and delivery terms, and in certain cases, to enter a promo code to receive a discount.

(6) You will also be required to provide data without which we cannot fulfill the contract. Such data typically includes names, a shipping address (when ordering goods), a phone number, and an email address; for business customers, it includes the company name, EIK, VAT number, managing director, as well as billing information—if you request an invoice; in certain cases, you will be given the option to register on the Site as a user.

(7) Before finalizing an order, the Customer should ensure that they are ordering a specifically selected product (goods or services) with certain characteristics from the category in which they are interested. The website features separate and clearly labeled categories for goods and services offered at a reduced price as part of promotional campaigns, or due to a defect in the product or its packaging as described in the listing, as well as for products that are unboxed or samples. This is explicitly stated in the listing on the Website. All other products offered are new, unused, and of the required quality.

(8) The customer undertakes and is responsible for ensuring that all information provided to TRAVEL BOOKS in connection with the order is true, complete, and accurate as of the date the order is submitted.

(9) After verifying the contents and details of the order, the customer should click (press) the “Order,” “Buy,” “Continue,” “Order,” or other similar option. By submitting the order, the customer authorizes TRAVEL BOOKS to contact them by any means necessary when required in connection with the order placed, its delivery, or the concluded contract. At this stage of the order, but before its completion, the Website informs the customer that a payment obligation exists.

Order Confirmation

Art. 14 (1) When placing an order through the Website, by phone, email, or via social media, the Website sends a notification to the customer, whereby the distance contract between you as the customer and TRAVEL BOOKS is deemed to have been concluded subject to a condition precedent within the meaning of Article 5, paragraph 10 of these General Terms and Conditions. The notification also confirms the successful registration of the order in the merchant’s system; however, this does not constitute acceptance, confirmation, or an undertaking to fulfill the order, unless otherwise specified in the notification. This notification also contains information pursuant to Articles 47 and 48 of the Consumer Protection Act, an excerpt from these General Terms and Conditions, and details regarding your order.

(2) The seller shall provide notice of acceptance and commitment to fulfill the order through the notice referred to in paragraph 1 or via a courier when the goods have already been delivered to the seller by the seller. In the latter case , the courier acts on behalf of TRAVEL BOOKS. At their discretion, the merchant may notify the consumer by email, SMS, or phone call.

(3) Until the time of notification under paragraph 2, the Seller has the right not to deliver some or all of the goods or not to perform some or all of the services specified in the order for various objective reasons, including but not limited to the exhaustion of their inventory. In such a case, the Seller’s sole liability for non-performance is to refund any advance payment received for the goods or services, without being liable for damages for the non-performance.

Entry into Force of the Agreement

Art. 15 (1) The distance salescontract between the seller and the Customer is deemed to have been concluded subject to a condition precedent as of the moment the Customer receives the notice under Art. 14, para. 1, regarding an order registered with the seller.

(2) Pursuant to the contract concluded between the parties, the seller undertakes, upon fulfillment of the conditions specified in Article 5, paragraph 10, to deliver, either personally or through third parties, to the customer or to persons designated by the customer, the goods or services ordered from the seller within the timeframes and under the terms and conditions set forth in these General Terms and Conditions, and the buyer undertakes to pay the agreed price and to accept the delivered goods or services.

(3) The contract is binding on the parties from the moment the seller notifies the customer that the goods or services are ready for delivery, with such notification being provided via email and/or SMS or a phone call to the customer stating that the goods are ready for shipment or the service can be provided.

(4) The sales contract concluded between the Customer and the Seller consists of these General Terms and Conditions and any additional agreements between the Seller and the Customer, as set forth in the confirmation of the concluded contract pursuant to Article 14, paragraph 1.

VI. TRANSFER OF OWNERSHIP

Art. 16 (1) Upon the sale of goods, ownership of the goods is transferred from TRAVEL BOOKS to the customer or to a third party or representative designated by the customer upon delivery of the goods to that person and after payment has been made by the customer, unless the amount has been paid in advance.

(2) Delivery of the goods is confirmed by the signature of the customer or a person or representative designated by the customer on the shipping document or receipt provided by the courier.

(3) The risk of loss or damage to the goods passes to the Customer as of the moment the goods are handed over by the courier to the Customer or a third party. If the courier is a person selected by the Customer, the risk shall be borne by the Customer from the moment the goods are handed over by TRAVEL BOOKS to the carrier. In all cases where a transport-related defect is discovered, the Customer is obligated to notify TRAVEL BOOKS within the timeframes and under the conditions set forth in Article 25 of these General Terms and Conditions.

VII. PAYMENT

Art. 17 (1) The prices of the goods and services listed on the Website are final and include VAT, as well as all other taxes and fees provided for in current Bulgarian law.

(2) The website contains a large number of products, and it is possible that, despite our best efforts, some of the product details—including the price—may be incorrect. If we discover an error in the price of the products you have ordered, we will notify you as soon as possible. We will give you the option to confirm your order at the correct price or to cancel it.

(3) TRAVEL BOOKS is not obligated to sell goods or services at incorrectly listed prices on the website.

Art. 18 (1) The price , method of payment, and payment deadline are specified in each order.

(2) Orders for products offered by the seller with a value exceeding 1,000 BGN cannot be paid upon delivery but must be paid in full in advance via bank transfer or credit card. Usually, if prepayment is required, this is specified in the listing.

(3) The seller will issue an invoice to the customer for the ordered goods or services based on the information provided by the customer. If the customer has not indicated that they wish to receive an invoice, TRAVEL BOOKS or the courier will provide only a sales receipt and/or a receipt for the sale upon receipt of cash payment, in accordance with applicable law.

(4) In the case of payments via PayPal or other similar payment systems, or payments made by bank transfer or credit card, the seller is not liable for any costs related to fees, commissions, or other additional charges incurred by the customer in connection with the transaction, as well as in cases of currency conversion applied by the bank that issued the customer’s card when the currency is other than the Bulgarian lev (BGN).

(5) Card payments made on the Site are treated as international payments by banks in Bulgaria, and in accordance with their rules for handling cards and card payments, some banks may charge additional fees for this type of transaction. Any costs associated with such payments are the sole responsibility of the buyer. Therefore, TRAVEL BOOKS recommends that its customers check with their bank regarding any additional fees that may be charged for online payments or bank transfers for products and services sold on the Site.

Art. 19 The customer is required to provide all necessary information for issuing the invoice in accordance with applicable Bulgarian law, if such information is required. The customer may do so when placing the order or later by notifying the seller.

(2) To ensure that the invoice for the relevant order is prepared correctly, the customer is required to keep the information in their profile—if they are registered—or in their order up to date at all times. The customer is required to review the information provided in the relevant order to ensure that it is complete, correct, and accurate.

Art. 20 Orders placed on the website may be paid for in the following ways:

(1) cash on delivery ( for orders of goods) – in this case, the cost of the ordered goods and the delivery (unless free of charge) must be paid by the customer, a third party designated by the customer, or the customer’s representative to the courier making the delivery, upon receipt of the goods in exchange for a receipt provided by the courier;

(2) by bank transfer —in this case, the cost of the ordered goods and/or services and the delivery (unless it is free of charge), shall be paid by the customer or by a third party of the customer’s choice into the seller’s bank account, and the payment shall be considered complete only after it has been confirmed and the corresponding amount has been credited to TRAVEL BOOKS’ bank account ;

(3) by debit or credit card (virtual POS terminal)— in this case, the cost of the ordered goods and/or services and the delivery (unless it is free), shall be paid by the customer or by a third party of the customer’s choice through our partner’s payment system, to which the customer will be automatically redirected and where the customer must enter their card details; the payment is considered complete only after the system successfully registers the payment and the funds are credited to TRAVEL BOOKS’ account; For payments other than bank transfers, the transaction is processed by payment institutions, and TRAVEL BOOKS does not receive any data regarding your credit or debit cards. When paying by credit card, the customer must enter the full details of the credit card used for payment in the payment form—card number, expiration date, CVC/CVV security code, and a personal secret password for 3D Secure authentication. By providing the required information, the customer or a third-party payer identifies themselves, confirms the payment amount, and authorizes the card account to be charged the payment amount and transferred to TRAVEL BOOKS’ account. The customer has no right to dispute a payment confirmed by entering the correct identification password (CVC/CVV security code, a personal secret password for 3D Secure authentication, or another password/authentication code) or a payment confirmed by entering a 6-digit access code for the mobile app.

(4) through a consumer loan (currently not applicable) – see Article 21 below in these Terms and Conditions – when this option becomes available, it will be explicitly stated in the advertisement;

(5) via PayPal (currently not applicable) – in this case, the cost of the ordered goods and/or services and shipping (unless free) must be paid by the customer or a third party of their choice via the PayPal system; If you choose this payment method, you will be redirected to the PayPal system, where you must enter your email address and password or create an account if you do not already have one. Payment is considered complete only after the payment transaction has been confirmed and the funds have been credited to TRAVEL BOOKS’ account;

Art. 21 A customer who wishes to purchase goods from the seller on an installment plan, provided that this service is available on the Website, must apply to a financial institution listed on the Website to obtain credit. This service may not be available for certain goods or for a specific period.

(2) Only a customer for whom the option to apply for credit is indicated on the Website for a specific online order is eligible to apply for credit.

(3) Applications may be submitted only online via the website www.travelbooks.bg and only through a profile registered by the customer on the Website or in the system of the lending institution, by clicking the “Buy on Credit” button, after which the prescribed procedure must be followed. The customer must fill out a form with their personal information in the designated fields and accept the general terms and conditions; they will then be redirected to the website of the relevant lending institution, where the Terms and Conditions for the Provision of Financial Services at a Distance apply.

(4) The conditions that a customer must meet in order to be granted a loan are determined unilaterally by the financial institution in accordance with its credit policy. The seller does not participate in any way in the financing of the purchase, nor in any of the relationships related to the financing, including, but not limited to, determining the conditions for applying for a loan, the approval or denial of the loan, the determination of the terms and duration of the loan agreement, or—in the event of default—the taking of legally prescribed enforcement actions, etc. The seller is not a representative and does not act as an intermediary on behalf of any commercial bank.

(5) If the customer is approved for the loan, the institution sends the relevant notification to the seller. Delivery of goods or services purchased on credit shall take place only after the seller has been duly notified by the financial institution that the applicant has been approved.

VIII. DELIVERY OF GOODS

Shipping Method

Art. 22 (1) TRAVEL BOOKS undertakes to deliver the ordered and purchased goods either directly or through a courier company to the address specified by the customer or to a courier company’s office, depending on the customer’s choice. In cases of door-to-door delivery, the customer must specify the floor to which the products are to be delivered in the address field of the online form on the Website. Otherwise, delivery will be made to the building specified as the delivery address.

(2) If the customer is registered on the Site and has more than one address saved in their profile, the shipment will be sent to the address designated as the primary address.

(2) TRAVEL BOOKS typically ships goods ordered by a customer via “Bulgarian Post,” through the courier company “Econt,” “Speedy,” or an equivalent service, and in certain cases, the customer has the right to choose during the ordering process which courier company will handle the delivery, as well as whether the delivery will be made to their office or to the doorstep of an address specified by the customer. Delivery at the prices listed on the website is for Bulgaria only. Delivery to other countries is calculated separately.

(3) Unless otherwise agreed, payment of the delivery fee shall be made together with payment of the order price; the timing of payment may vary depending on the payment method selected by the customer in accordance with Art. 20 of these General Terms and Conditions.

(4) TRAVEL BOOKS will deliver goods and provide services only within Bulgaria. For deliveries to other countries in the European Union or to third countries, TRAVEL BOOKS offers its goods and services on other platforms suitable for this purpose, with listings described in the appropriate language. If a customer wishes to have a specific product delivered to an address outside of Bulgaria, the customer should contact TRAVEL BOOKS.

Shipping Cost

Art. 23 (1) The shipping cost for goods ordered from TRAVEL BOOKS is calculated automatically before the customer completes their order.

(2) The shipping cost depends on the selected carrier, the size and volume of the shipment, and the delivery address; within Bulgaria, it ranges from 3.00 BGN to 50.00 BGN for standard shipments weighing up to 10 kg. To calculate the exact shipping cost, review your order or use the shipping cost calculator on Econt or Speedy. Tip: Delivery to a courier office is more cost-effective than delivery to a specified address.

(3) TRAVEL BOOKS reserves the right to waive the shipping fee for Customers who place orders above a certain amount. This will be indicated on the website and when placing an order.

(4) In certain cases, the courier company charges additional fees for services such as delivery at a specific time, delivery on a holiday, and SMS notification of a received shipment.

Delivery Time

Art. 24 (1) Orders for goods from www.travelbooks.bg are accepted 24 hours a day, including on weekends and public holidays. Accepted orders are processed and shipped via courier within 1–3 business days, starting from the day you receive the notification under Art. 14, para. 2, that we will fulfill the order. The delivery time is extended accordingly by the number of days off for orders placed on Friday, Saturday, Sunday, and on public holidays.

(2) The maximum delivery time for goods within the Republic of Bulgaria is 7 (seven) business days from the date of the seller’s confirmation under Article 14, paragraph 2, that the order will be fulfilled.

(3) The delivery time for goods ordered under credit or installment payment terms is between 24 hours and 4 business days and begins to run from the moment TRAVEL BOOKS receives notification of the credit applicant’s approval and receives the amount credited for the products/services.

(4) TRAVEL BOOKS reserves the right to unilaterally extend the delivery period by up to 7 business days without notifying the customer, and to extend the delivery period by more than 7 business days with the customer’s prior consent.

(4) In all cases, there may be delays in the specified delivery times, of which TRAVEL BOOKS will notify you in a timely manner.

(5) TRAVEL BOOKS shall not be liable for any delay in delivery due to circumstances beyond TRAVEL BOOKS’ control, such as a delay on the part of the courier making the delivery, a prohibition by a government authority, extraordinary or force majeure circumstances, or force majeure as defined in Article 306 of the Commercial Code.

(6) TRAVEL BOOKS reserves the right to unilaterally extend the delivery period or refuse to deliver goods or services in cases where the order is placed with payment via bank transfer, a virtual POS/card, and the payment has not been credited to the seller’s account.

Inspection for Defects upon Delivery

Art. 25 (1) Upon delivery of goods ordered from TRAVEL BOOKS, the customer is obligated to carefully inspect them in person or through a third party authorized by the customer to accept the goods.

(2) If any visible external defects are found—such as damage, dents, or other damage discovered upon delivery—the customer or a third party must sign a damage report in the presence of the courier, which report shall describe the defects found, and immediately, no later than 48 hours after delivery, notify TRAVEL BOOKS of the findings.

(3) When the delivered goods clearly do not correspond to those ordered by the Customer and this can be determined by a simple inspection of the delivered goods, the Customer has the right, within 48 hours, to request that TRAVEL BOOKS replace the delivered goods with goods that correspond to the order.

(4) Notification may be provided by any of the methods listed in Section II of these General Terms and Conditions or via the contact form on the website www.travelbooks.bg.

(5) Upon receipt of a notification in accordance with the preceding paragraphs, TRAVEL BOOKS will replace the damaged/non-conforming goods within 3 (three) business days, except in cases where goods of the same type are not available, in which case TRAVEL BOOKS will inform the customer in a timely manner and agree with the customer on the terms of the replacement.

Receipt of the shipment

Art. 26 (1) Upon acceptance of the delivery by the customer or a third party without any objections, any and all subsequent claims regarding external visible defects in the received goods shall be deemed unfounded and, as such, shall not be honored. If a damage report is not prepared and signed in the presence of the courier upon receipt of the goods and/or the customer does not immediately notify TRAVEL BOOKS within 48 hours of delivery via the phone number oremail/address listed on the Website, the customer forfeits the right to claim for the identified external visible defects in accordance with the sales contract.

(2) The foregoing does not relieve TRAVEL BOOKS of its obligation to offer goods and services in accordance with the sales contract and to grant the consumer (natural person) the rights arising from the statutory warranty, as described in Section X of these General Terms and Conditions.

(3) If the consumer refuses to accept the delivery, the consumer is liable for all costs associated with the delivery, including the cost of courier services and packaging.

Art. 27 Upon delivery of the goods (except in cases of cash-on-delivery), the customer or a third party accepting the delivery at the address specified by the customer is required to sign the accompanying documents. A third party is defined as any person who did not place the order but accepts the goods upon delivery at the delivery address specified by the Customer.

Art. 28 TRAVEL BOOKS ensures that the goods are properly packaged and that the accompanying documents are included in the shipment. If, for any reason, the shipment does not contain a document or component required for the ordered product, please contact us and we will do everything possible to provide it as quickly as possible.

Non-acceptance of the order and unjustified refusal

Art. 28a If a customer or a person designated by the customer cannot be located at the specified delivery address within the delivery timeframe and/or access to the delivery address is not provided, TRAVEL BOOKS will consider this an unjustified refusal of the order and will be released from its obligation to deliver the ordered goods, and the customer will lose the opportunity to have the goods they ordered delivered to them.

(2) TRAVEL BOOKS reserves the right to send a notice of an unclaimed shipment to the email or physical address provided by the customer, as well as to claim the costs of delivery and return of the item(s). TRAVEL BOOKS and the customer agree that the notice, when sent electronically, shall be deemed to be in writing and received on the date it is sent by TRAVEL BOOKS, without the need for the notice to be signed with an electronic signature.

(3) In the above cases, the customer may confirm their desire to receive the goods even after the delivery period has expired and they were not found at the address; however, they must bear all delivery costs. In this case, a new delivery period begins from the time of confirmation. TRAVEL BOOKS is released from its delivery obligation if the ordered goods are no longer available.

(4) In the cases referred to in paragraph 2 of this Article, the customer shall pay TRAVEL BOOKS the amount for delivery and return of the goods within 7 days of receiving the notice, unless the notice specifies a different deadline.

  1. RIGHT TO CANCEL AND EXCHANGE A PRODUCT

Attention! This section applies only to individual customers (consumers).

Right of Withdrawal and Right of Replacement Periods

Art.29 (1) Within 14 days of the conclusion of the contract (order), when a service has been ordered, or within 14 days of receipt of the goods—in the case of an order for goods— the consumer has the right to cancel the order for the goods/service from the Website without giving any reason or cause and without owing any penalties or other compensation to TRAVEL BOOKS, except for the costs of returning the goods, as well as the costs of the initial shipment of the goods, when the shipment, at the customer’s request, was carried out by a postal operator other than “Bulgarian Post.” In the event that the product and/or packaging are damaged beyond what is customary for the goods to be resold, TRAVEL BOOKS has the right, pursuant to Article 35, to deduct an amount corresponding to the reduced value of the goods from the amount subject to refund, which may not exceed the value of the goods.

(2) When the consumer exercises his or her right to withdraw from a distance contract or an off-premises contract, any ancillary contract is automatically terminated, without the consumer being liable for any costs, compensation, and/or penalties, with the exception of the costs provided for in Article 29, paragraph 1, in conjunction with Article 35 of these General Terms and Conditions. This provision does not apply with respect to Article 28 of the Consumer Credit Act.

(3) The right of withdrawal does not apply; accordingly, TRAVEL BOOKS has the right to refuse to honor a withdrawal from an order if : i) the deadline for exercising the right of withdrawal has expired; ii) the consumer has not returned the goods to the seller within the time limit specified in Article 33; iii) the consumer has not returned the goods in their entirety, together with all components and accessories; iv) there is insufficient evidence to establish that the product was purchased from TRAVEL BOOKS (no invoice, receipt, or other proof of purchase); v) the right of withdrawal is exercised for a service that, at the consumer’s request, began immediately after the order was placed, and the consumer has agreed to waive their right of withdrawal; vi) the cases described in Article 30 of these General Terms and Conditions; vii) the withdrawal clearly constitutes an abuse of rights on the part of the consumer—for example, the returned goods have clearly been used beyond what is necessary for testing, or the consumer has damaged the goods; viii) the customer has returned the product via cash-on-delivery—in this case, TRAVEL BOOKS has the right to refuse to accept the returned product and to refuse to pay the cash-on-delivery fee;

(4) The withdrawalperiod for an order containing multiple items, delivered on different days, is 14 days from the date on which the consumer or a third party designated by the consumer takes possession of (receives) the last item in the order;

(5) The withdrawal period for an order consisting of multiple items or parts is 14 days from the date on which the consumer or a third party designated by the consumer takes possession of the last item or part;

(6) The cancellation period for a subscription order under which goods are regularly delivered for a specified period (for example, a subscription to receive a product every month), is 14 days from the date on which the consumer or a third party designated by the consumer takes possession of the first item;

Goods and services for which the customer has no right of return or exchange

Art. 30 The customer may not cancel the contract or request a replacement product in the following cases:

(1) in the case of the provision of services where the service has been fully provided and its performance has begun with the consumer’s express prior consent and confirmation on the consumer’s part that he or she is aware that he or she will lose the right of withdrawal, once the contract has been fully performed by the seller;

(2) in the case of the supply of goods or services whose price depends on fluctuations in the financial market that are beyond the control of the sellers and that may occur during the withdrawal period;

(3) in the case of the delivery of goods manufactured to the consumer’s order or in accordance with the consumer’s individual requirements;

(4) in the case of the delivery of goods that, by their nature, are liable to deteriorate or have a short shelf life;

(5) in the case of delivery of sealed goods that have been unsealed after delivery and cannot be returned for reasons related to hygiene or health protection;

(6) in the case of the supply of goods which, after being delivered, have, by their very nature, become mixed with other goods from which they cannot be separated;

(7) upon delivery of sealed audio or video recordings or sealed computer software that have been unsealed after delivery, as well as those on which the consumer has made configuration adjustments or other changes to the software of the product;

(8) in the case of the supply of digital content that is not delivered on a tangible medium, where performance has begun with the customer’s express consent, and the customer has confirmed that they are aware that they will thereby lose their right of withdrawal;

(9) in the case of delivery of goods that are not mass-produced, are not kept in stock, but are custom-made specifically for the Customer;

(10) upon delivery of goods that have been processed by the Customer;

(11) if the returned product shows visible signs of use by the Customer or is damaged;

Art. 31 (1) Within 14 days of receiving the goods, the consumer also has the right to exchange a product if the goods delivered do not meet the consumer’s expectations given the product’s normal intended use.

(2) If the right to exchange has been exercised and the conditions for its acceptance are met, TRAVEL BOOKS is obligated to replace the product with another one within 14 (fourteen) days from the date on which the consumer returned the relevant product to TRAVEL BOOKS. If the seller does not have the requested product in stock and it is not available, it shall offer the consumer another product; if the consumer agrees, the exchange shall be made for that other product, and in the event of a price difference between the two products, the parties shall agree on the method of paying the additional amount or refunding the difference in the sales price. In the absence of such agreement, TRAVEL BOOKS shall refund to the consumer the amount paid for the goods within the timeframes and under the conditions specified in the preceding paragraphs of this provision.

Notice of Rejection

Art. 32 (1) The consumer’snotification that he or she is withdrawing from the contract or wishes to exchange the product received for another of the same type must be made within the time limit specified in Art. 29, in one of the following ways:

  • by calling the TRAVEL BOOKS contact numbers;
  • by sending a free-form email to the Seller’s email address;
  • by sending a letter with return receipt requested to TRAVEL BOOKS ’ address in free text;
  • by completing and sending to TRAVEL BOOKS the Standard Withdrawal Form provided below;

(2) The consumer may, but is not required to, use the Standard Form for Withdrawal or Exchange, as follows:

Returning Merchandise

Art. 33 (1) In the event of cancellation of an order for goods from TRAVEL BOOKS, as well as in the event of a request for an exchange, the consumer must, within 14 days of notifying TRAVEL BOOKS of the cancellation or request for an exchange, return the product in its entirety and in the same condition as when it was received, along with the invoice issued by TRAVEL BOOKS and/or the receipt issued by the seller or the courier who delivered the goods, to the following address: Sofia, 12 Georgi Bakalov St.

(2) When returning the product, the consumer should inform the postal operator or courier company that they wish to use the “Inspection of Goods” service, as our department checks the condition of the goods before accepting the return and refunding the consumer.

(3) The consumer is responsible for the cost of returning the goods. If the consumer has not paid for return shipping, TRAVEL BOOKS will deduct the shipping costs from the refundable amount and return the difference to the consumer.

Refund of a Paid Amount

Art.34 (1) If the right of withdrawal has been exercised and the conditions for its acceptance are met, TRAVEL BOOKS undertakes to refund the price paid under the distance contract from which the consumer has withdrawn, within 14 (fourteen) days from the date on which the consumer returned the relevant product or from the date of provision of indisputable proof of the product’s return by the consumer. If the right of withdrawal is exercised with respect to services, the deadline for refunding the amounts paid by the consumer is 14 (fourteen) days from the date TRAVEL BOOKS is notified of the withdrawal. Refunds shall be issued after deducting any amounts in accordance with Article 35, if applicable.

(2) The amount to be refunded under paragraph 1 includes the price paid by the consumer for the goods or services, excluding the cost of shipping.

(3) The amount will be refunded as follows, without incurring any additional costs to the consumer, unless the bank or payment institution serving the consumer charges any fees:

  • Payments made by bank transfer, debit card, or credit card will be refunded to the bank account provided by the customer or credited back to the account from which the payment was made. At the customer’s request, the refund may be issued using the same method used to pay for the order;
  • Payments made via cash on delivery or by other means—such as to a bank account additionally provided by the consumer;
  • Payments on consumer loans – following the termination of the consumer loan agreement and the recalculation of the loan installments – most often to the bank account from which the loan installment payments were originally made, or by another method specified by the bank that granted the loan.

Withholding of Amounts

Art. 35 TRAVEL BOOKS has the right to deduct the following amounts from the amount specified in Art. 34, para. 1, prior to its refund:

(1) an amount equal to the reduced value of the product, including its packaging, if, upon return, it is determined that the product or its packaging has been worn out or damaged in a manner not attributable to normal use;

(2) the amount corresponding to the portion of the service performed up to the time of the cancellation, if the consumer has indicated that they wish the service to begin immediately;

(3) the proportionate amount of what has actually been provided to the consumer up to the time the consumer notified TRAVEL BOOKS of the cancellation;

(4) the cost of returning the merchandise to TRAVEL BOOKS;

(5) the costs of the initial shipment of the goods, when the shipment, at the customer’s request, was carried out by a postal operator other than “Bulgarian Post.”

Art. 36 In cases where the performance of a service has begun within 14 days of the order, with the consumer’s prior consent and upon receipt of a deposit from the customer, and the customer subsequently exercises their right of withdrawal, TRAVEL BOOKS shall be entitled to withhold from the deposit an amount equivalent to the services performed up to the time of the cancellation. In the absence of a deposit, TRAVEL BOOKS reserves the right to claim payment of the amount from the Customer.

Other cases of refusal (cancellation)

Art. 38 (1) TRAVEL BOOKS has the right to refuse to fulfill (cancel) an order placed by the user, in which case it must notify the user in an appropriate manner.

(2) If an order is canceled prior to confirmation of the possibility of fulfillment within the meaning of Article 14, paragraph 2, TRAVEL BOOKS shall not be liable and shall not owe any compensation or penalties to the consumer.

(3) TRAVEL BOOKS may unilaterally cancel an order, if the customer has ordered a product or service from the Website, indicating that the order is intended for a third party (e.g., as a gift), whose information the customer has provided for delivery purposes. In this case, the order may be canceled if TRAVEL BOOKS suspects that the shipment is intended for a threatening, offensive, mocking, or other purpose contrary to public decency and morality.

Art. 39 The cancellation of an order shall not entail any liability or subsequent obligation of either party toward the other in connection therewith, and accordingly, neither party shall be entitled to seek compensation from the other for such cancellation in the following cases:

(1) the customer’s transaction is not accepted by the issuing bank during an online payment;

(2) the execution of the monetary transaction in such a way that no funds are credited to the seller’s account in the case of online payments;

(3) failure by the seller to fulfill or cancellation of an order before such order has been confirmed within the meaning of Article 14, paragraph 2 of these General Terms and Conditions;

Art. 40. In the cases referred to in Art. 39, the order is automatically canceled.

X. WARRANTY. RIGHT TO FILE A CLAIM

Attention! This section applies only to individual customers (consumers). Claims regarding goods whose expiration date (shelf life) and/or “Best Before” date, as indicated on the packaging, have expired after receipt of the goods will not be accepted, unless otherwise provided by law.

Nonconformity of the Goods with the Contract. Statutory Warranty

Art. 41 (1) TRAVEL BOOKS offers all products on the Site with a statutory warranty of conformity with the contract in accordance with applicable law. A product conforms to the contract when it possesses the quality, functionality, and intended purpose customary for that type of product. Services ordered through the Website are covered by a warranty of conformity with the contract only if this is expressly stated in the service listing.

(2) Any nonconformity of consumer goods with the sales contract that becomes apparent within 6 months of delivery of the goods is presumed to have existed at the time of delivery, unless the seller proves that the nonconformity is due to other causes for which TRAVEL BOOKS is not responsible. For nonconformities that become apparent after the 6-month period, the consumer must prove that TRAVEL BOOKS is responsible for the defect.

Deadline for Filing a Complaint

Art. 42 A complaint regarding a consumer good or service may be filed by the consumer in accordance with the procedure set forth in Art. 44 within the following time limits:

(1) within 24 months of the delivery of the goods, but no later than two months after the nonconformity with the contract is established, unless the nonconformity is apparent, in which case the time limits specified in paragraph 2 of this provision shall apply;

(2) within 48 hours of receipt of the goods, where the nonconformity is external, visible, and obvious, and could have been detected upon a reasonable inspection at the time of or immediately after delivery;

( 3) The time limit is suspended for the time necessary for TRAVEL BOOKS and the user to reach an agreement on the resolution of the dispute.

(4) The warranty period begins on the date the goods are received.

Art. 43 There is no nonconformity of the goods with the sales contract in the following cases:

(1) the deviation/nonconformity is not significant;

(2) The consumer had specific requirements regarding the product that were not communicated in writing to TRAVEL BOOKS prior to placing the order, and the product does not meet those expectations;

(3) the nonconformity is due to the nature of the goods and their normal wear and tear over time;

(4) the nonconformity is caused by improper operation, installation, storage, or use of the product;

(5) At the time of concluding the contract (placing the order), the consumer knew or could not have been unaware of the nonconformity—for example, at the time of the order, the consumer was informed by us that the product had certain nonconformities compared to the usual (e.g., goods from a category on the website featuring discounted items, defective goods, or unboxed goods, where the website clearly states that the price has been reduced due to a defect or specific circumstance);

(6) the nonconformity is visible and obvious and concerns the appearance of the goods (e.g., scratches, tears in the packaging, or missing parts of the product’s contents) and could have been detected during a routine inspection of the goods upon receipt (delivery), and yet the consumer did not sign a damage report with the courier and/or did not notify TRAVEL BOOKS within the time limits specified in Article 26, paragraph 1 of these General Terms and Conditions;

(7) the defect became apparent after the expiration date indicated on the product’s packaging had passed;

Complaint

Art. 44 (1) The consumer has the right, within the time limits specified in Art. 42, to file a complaint with TRAVEL BOOKS regarding any nonconformity of the goods with what was agreed upon or ordered, if, after delivery, discrepancies between the goods and the sales contract are discovered, regardless of whether the manufacturer, importer, or seller has provided a commercial warranty for the goods.

(2) TRAVEL BOOKS’ bringing the consumer goods into conformity with the sales contract is free of charge to the consumer. The consumer is not liable for shipping costs for the consumer goods or for materials and labor related to their repair, nor shall the consumer suffer significant inconvenience.

(3) When filing a complaint, the consumer shall specify the subject of the complaint, the preferred method of resolving the complaint, and the preferred method of contact;

(4) Filing a complaint does not preclude the filing of a lawsuit.

(5) When filing a complaint, the consumer must attach the documents on which the claim is based, namely: i) a receipt or invoice; ii) reports, statements, or other documents establishing that the goods or services do not conform to what was agreed upon—if available; iii) other documents establishing the grounds for and amount of the claim.

(6) The complaint may be submitted to TRAVEL BOOKS in one of the following ways, at the customer’s discretion:

  • by calling the TRAVEL BOOKS contact numbers;
  • in person at our office: Sofia, 12 Georgi Bakalov St.
  • by email to TRAVEL BOOKS’ email address in free-form text;
  • by sending a letter with return receipt requested to TRAVEL BOOKS ’ address in free text;

Art. 45 (1) In cases where a complaint is filed outside of a TRAVEL BOOKS location, the consumer must send the merchandise to the seller’s address: Sofia, 12 Georgi Bakalov St.

(2) TRAVEL BOOKS will cover the shipping costs if the complaint is found to be valid and the consumer returns the product via “Bulgarian Post.” If another method is chosen, or in the case of unfounded complaints, TRAVEL BOOKS is not responsible for the shipping costs.

Art. 46 If TRAVEL BOOKS has provided a commercial warranty for the goods, in addition to the statutory warranty under Art. 42, and the term of the commercial warranty is longer than the time limits for filing a complaint, the claim may be filed until the expiration of the commercial warranty period.

Recording the complaint. Bringing into compliance

Art. 47 (1) Upon receipt of a complaint, TRAVEL BOOKS shall record it in the Complaints Register, providing the consumer with the complaint number and date, as well as information regarding which employee received the complaint.

(2) Within 30 days of the complaint being filed, TRAVEL BOOKS shall determine whether the complaint is valid or not.

Art. 48 In the event of valid complaints, TRAVEL BOOKS shall bring the goods into conformity with the sales contract within the time limit specified in Art. 47, para. 2. The goods shall be brought into conformity with the contract free of charge in one of the following ways, at the Seller’s discretion, depending on the nature of the nonconformity:

(1) Repair of the product (if possible and applicable) – all repairs to products purchased from the Website are performed in Bulgaria at service centers authorized by the seller;

(2) replacement of the goods with new ones of the same type;

Art. 49 (1) If any of the actions specified in Art. 48, paras. 1 and 2, prove impossible or inappropriate for reasons such as the impossibility of repair due to excessive repair costs exceeding the value of the goods, due to a material, irreparable defect or the nature of the goods, or the impossibility of replacement due to the product being out of stock, TRAVEL BOOKS shall refund the amount paid by the consumer for the goods and their delivery.

(2) TRAVEL BOOKS is also obligated to refund the price of the goods and the delivery charges in the following cases:

  • the product, which has already been repaired three times, has been repaired again within the time limit specified in Article 42, paragraph 1, and the product has once again proven to be nonconforming;
  • when the seller has not ruled on the complaint within the time limit specified in Article 47(2) of these General Terms and Conditions;

Art. 50 (1) If TRAVEL BOOKS fails, without just cause, to repair or replace the goods within the time limit specified in Article 47, paragraph 2, the consumer has the right to terminate the contract and receive a refund of the amount paid, or to request a reduction in the price of the goods.

(2) The consumer may not claim rescission of the contract if the nonconformity of the consumer goods with the contract is minor.

(3) The consumer is entitled to the rights under paragraph 1 even if he or she is not satisfied with TRAVEL BOOKS ’ resolution of the complaint . TRAVEL BOOKS is obligated to satisfy the consumer’s request if, after having resolved three of the consumer’s complaints by repairing the same item within the time limit specified in Article 42, paragraph 1, a subsequent instance of nonconformity of the goods with the sales contract occurs.

(4) The consumer may not claim a refund of the amount paid or a price reduction for the goods, if TRAVEL BOOKS agrees to replace the consumer’s goods with new ones or to repair the goods within one month of the consumer filing a complaint.

Unfounded Complaint

Art. 51. A complaint is unfounded and will not be upheld when:

(1) was filed after the expiration of the time limits set forth in Article 42;

(2) any of the conditions set forth in Article 43 are met;

(3) the product was manufactured using materials provided by the consumer, which, due to their quality, resulted in the finished product made from those materials being nonconforming;

(4) the consumer has not provided the documents specified in Article 44, paragraph 5, and/or has not returned the product, or has returned it without the accompanying accessories and/or components;

(5) repairs have been performed or an attempt has been made to perform repairs and correct a defect by a person or service center not authorized by TRAVEL BOOKS;

(6) a modification or change to the technical specifications has been made without the knowledge or consent of TRAVEL BOOKS, outside of a service center authorized by TRAVEL BOOKS, and/or in violation of these General Terms and Conditions;

(7) there is damage caused by the user and/or a third party for which TRAVEL BOOKS is not liable, as well as in cases where the defect is caused by other modules and devices used in conjunction with the product covered by the warranty;

(8) the physical integrity of the product and/or the warranty stickers, seals, and factory labels intended to prevent unauthorized tampering has been compromised;

(9) in the event of chemical, electrical, and/or other influences unrelated to the normal operation of the product, as well as when the defect is caused by circumstances for which TRAVEL BOOKS is not responsible—power grid malfunctions, power surges, lightning, improper grounding, mechanical deformations, natural disasters, failure to comply with the specified power supply requirements, or damage caused by water or moisture;

(10) the complaint concerns a product that was not purchased from TRAVEL BOOKS ( for example, you stated that the product was purchased from us, but you sent us a different product);

(11) If a complaint has been filed and the product returned by the consumer is in poor condition, provided that the condition of the product indisputably indicates: i) abuse of rights; ii) the consumer’s failure to exercise due care; iii) improper use and/or maintenance of the product, from which it may be concluded that the defect was caused by the consumer’s fault (scratches, chips, dents on the product and/or its components; signs of force applied to the product; drops, crushing, etc.); iv) improper installation, assembly, or tampering; v) removal or modification of product components by third parties;

(12) there is no inconsistency;

Art. 52 (1) In the event of an unfounded complaint, TRAVEL BOOKS shall notify the consumer in writing of its decision and shall be released from any obligation to accept the complaint and to bring the goods into conformity with the contract.

(2) The repair or servicing of products outside the warranty period or within that period, provided that TRAVEL BOOKS ’ obligation to bring the goods into conformity with the sales contract has ceased for any reason, shall be paid for by the consumer and shall be performed within a timeframe agreed upon by the parties.

  1. INTELLECTUAL PROPERTY

Art. 54 (1) All content on the Website, namely—the logo, together with the figures and text contained therein, captions and images, drawings, diagrams, charts, designs, databases, descriptions, methods, processes, and other intellectual property and copyrighted works, as well as the content of the General Terms and Conditions, are the property of “Travel Books” Ltd. or of third parties from whom “Travel Books” Ltd. has obtained consent to reproduce and/or has a contract for the use of the intellectual property and/or copyrighted material.

(2) TRAVEL BOOKS is a trade name and domain name used by “Travel Books” Ltd.

Art. 55 TRAVEL BOOKS reserves all of its intellectual property rights related in any way to the Site.

Art. 56 Certain products featured on the Site have their own specific and unique design, owned by TRAVEL BOOKS, which is subject to copyright and intellectual property rights.

Art. 57 Visitors to the Site may use the content solely for the purposes of buying and selling. Use of the content for purposes other than those set forth in the Terms and Conditions is considered a violation of these Terms and Conditions of the Website, as well as a violation of the intellectual property rights owned by “Travel Books” Ltd.

Art. 58 Every product and service displayed and offered on the Site complies with the European and national requirements applicable to the specific product or service.

Art. 59 (1) Visitors to the Site may copy, share, transfer, and/or use the content solely for personal, non-commercial purposes and only in cases where this does not conflict with the provisions of this chapter of this document and where express written consent has been obtained from “Travel Books” Ltd. or third parties holding copyrights and other intellectual property rights who have given their consent to the use of their works and other intellectual property.

(2) TRAVEL BOOKS grants owners of other websites and users the right to post links to the online store only if the reference is clear and unambiguous.

(3) It is prohibited to copy text from the Site and post it on other websites or online stores without the written consent of TRAVEL BOOKS or without citing the source by including the following text: “Source: online store /specify the domain of our Site/,” and the link must lead to the TRAVEL BOOKS online store.

XII. ADVERTISING

Art. 60 (1) When a natural person user creates a profile (account) on the Site and/or places an order, they have the option to consent to receiving promotional messages. They may also indicate this preference by filling out the subscription form available on the Site.

(2) Any person may also consent to receiving such communications by filling out the subscription form on the Website, sending a message/letter to the addresses listed on the website, or by checking a box specifically indicating consent to receive advertising.

(3) To send promotional messages to legal entities that have registered an account on the Site and/or to corporate customers who have ordered goods or services from the Site, TRAVEL BOOKS is under no obligation to request consent to send promotional messages.

Art. 61 (1) The user may opt out of receiving promotional messages at any time by using the special link included in each promotional message, by changing the settings in their account, or by contacting TRAVEL BOOKS in any other manner specified in these General Terms and Conditions and on the Website.

(2) Refusal to receive promotional messages does not constitute an automatic withdrawal of the consent given to enter into this contract.

XIII. POSTING A COMMENT. QUESTIONS AND ANSWERS

Art. 62 Visitors may post comments, questions, and answers, where applicable, in the comments section . Comments may be either positive or negative and must be factual and relate to the characteristics and use of a particular product or service.

Art. 63 Every visitor is required to comply with the following rules when posting a comment, question, or answer in the specified sections:

(1) refer only to the characteristics and/or intended use of a specific product or service, omitting information related to aspects that may change (e.g., price or promotional offers);

(2) to use only the Bulgarian language and to write in the Cyrillic alphabet; words or expressions that, although not Bulgarian, are widely used by all media in the relevant field are permitted (e.g., mouse, notebook, plug and play);

(3) to use appropriate language that does not contain offensive expressions or expressions that may infringe on the rights of a third party;

(4) to ensure that the information they enter is realistic, accurate, not misleading, and in compliance with applicable laws, including respect for the rights of others—e.g., copyrights, intellectual property rights, licensing rights, or other property rights, publicity rights, or the right to privacy.

(5) to use this service solely to communicate or obtain additional details regarding a specific product or service from the Site, without making references to other companies that promote the sale and purchase of products and/or services;

(6) not to provide or request, in any manner or form, personal data (contact information, shipping or residential address, phone numbers, email addresses, first and/or last names, etc.) or other information that could lead to the disclosure of such personal data;

(7) not to publish information and/or details regarding URLs (links) from other websites that engage in the same or similar commercial activities as TRAVEL BOOKS.

(8) not to post comments, questions, or answers that contain promotional material;

Art. 64 When a specific person reports that a comment, question, or answer contains inappropriate content or content that violates these Terms and Conditions, such content is carefully reviewed by TRAVEL BOOKS so that it may determine whether it violates the Site’s Terms of Use. Published texts, photos, or videos are removed from the Site only after verification by TRAVEL BOOKS.

Art. 65 In the event that TRAVEL BOOKS detects repeated violations of these Terms of Use, it reserves the right to restrict the ability of the specific user to post comments, questions, and answers, without being required to provide a justification for doing so.

XIV. LIABILITY
Art. 66 (1) TRAVEL BOOKS and the customer shall be liable for any act or omission that has caused damage to either party, including lost profits, in accordance with these General Terms and Conditions and Bulgarian law.

(2) TRAVEL BOOKS / The client shall not be liable for any damages incurred by the client as a result of force majeure or circumstances beyond the party’s control.

XV. PROCESSING OF PERSONAL DATA

Article 67 (1) In accordance with the General Data Protection Regulation (Regulation (EU) 2016/679) and Bulgarian law, TRAVEL BOOKS, and more specifically “Travel Books” Ltd., is the data controller.

(2) TRAVEL BOOKS has adopted a Privacy Policy and a Cookie Policy, which every visitor whose personal data is processed by TRAVEL BOOKS or to whom cookies are applied must accept, after reviewing them.

Art. 68 A visitor’s personal data may be disclosed to the prosecutor’s office, the police, judicial institutions, or other government agencies, on the grounds and within the scope of the provisions of the law, and in response to an explicit request from them.

XVI. GOVERNING LAW – JURISDICTION

Art. 69 Disputes arising between TRAVEL BOOKS and consumers and corporate clients shall be resolved by mutual agreement or, if this is not possible, the disputes shall be resolved in accordance with Bulgarian law, unless the parties have agreed otherwise.

Art. 70 Individual consumers may use the European Online Dispute Resolution (ODR) platform, available at http://ec.europa.eu/odr , which serves as a single access portal enabling consumers and traders in the EU to resolve disputes that have arisen between them.

XVII. CORRESPONDENCE BETWEEN THE PARTIES

Art. 71 TRAVEL BOOKS and all customers (individuals and legal entities), as well as visitors to the Website, agree that the following shall be used for communication between the parties:

Art. 72 Notices and communications exchanged between the parties via electronic mail (email) shall be deemed to be in writing, and the parties shall treat them as having the same legal effect as a written document, without the need for an electronic signature.
